PODCAST GUEST RELEASE

Agreement by and between Jacqueline Rose Wellness LLC ( And/or Wild Rose Counseling LLC) (the

“Producer”), producer of the podcast entitled BodMedicine Podcast (the “Program”), and: the

undersigned guest (the “Guest”, “I”, or “Me”) in connection with Guest’s appearance for an

interview (or performance) (the “Interview”) for the Podcast. The parties hereby agree as

follows:

1. Podcast Guest Expectations, Responsibilities & Services.

I agree to participate as a Guest and provide an Interview (as defined below) for BodyMedicine

Podcast, and I agree to the following expectations, responsibilities and services:

a. Interview. I agree to share my story and/or expertise/knowledge with the Interview Host

for the Event in an interview that will be approximately 35-50 minutes in length

(“Interview”). I agree to be available for up to 60 minutes for the Event.

(1) Title and Topic. I agree that the title of the Interview will be determined by the

Interview Host. I agree to present the topic and content that was discussed and agreed

upon in advance with the Interview Host.

(2) Recording. I agree to the interview being pre-recorded and aired/published by

video/audio at a later date to be determined by the Interview Host. I agree that the

Interview Host may use my voice and likeness.

(3) Editing. I understand that the Host reserves the right to edit the Interview recording

for clarity, length, or other necessary changes, and that certain sections may be edited

out prior to airing. Such determinations shall be made in the I Host’s sole discretion.

(4) Interview Materials. I understand that the Host reserves the right to edit any interview

handouts and other materials agreed upon in advance with the Interview Host

(“Interview Materials”) for typos, accuracy and length. I agree that the Interview

Materials that I submit are my original materials and that their use will not infringe

upon the intellectual property rights of others, including copyrights and trademarks. I

understand that I may use and share the information and knowledge used to prepare

the Interview Materials in my business and otherwise, now and in the future, without

any restriction.

(5) Sound Quality. I agree to follow the guidelines for sound quality provided by the Host

to the extent possible to ensure the best possible sound quality for the Event.

b. Information to be Provided to Host.

I agree to email the following to the Host at

info@jacquelinerosewellness.com at least 3 business days prior to the Event.

(1) Interview Materials (Topics named in Calendly Invite)

(2) Bio, Contact, and Headshot. Bio will be read, in part or in full, in the Interview

introduction and will be provided in the Event's show notes. Headshot and

contact information may be included in promotional materials.

(3) Free gift. If I choose to provide a free gift (discount, download, e-course, etc.) to the

Event audience, I understand that it is to be approved in advance by the Host. I will

provide the Host with the name, details, and directions as to how the audience can

access the free gift.

(4) Links. I agree to provide the Host with any links to my website, social media, free

gift opt-in, etc. that I would like to be included in the show notes.

2. Promotion of Podcast Guest. I understand that the Interview Host may use the

information that I have provided to promote and market the Interview before and/or

during the Event, including, but not limited to, my name, title, headshot and bio, in part

or in full.

3. Replay Link & Recording. I understand that the Host reserves the right to send out the

replay link and recording to the audience for a limited time and/or for payment. I

understand that I will be provided with a copy or link to the recording that I may use on

my website or for other purposes.

CONSENT: Guest does hereby irrevocably consent to appear in the Program and to be

recorded, filmed, videotaped or otherwise to have their voice and performance captured,

reproduced and distributed. Guest further agrees that the Producer shall have the exclusive

right to edit the content of and to make derivative works using the Interview.

NAME & LIKENESS: Guest hereby irrevocably authorizes Producer to use Guest’s name,

image, likeness, appearance, voice, professional and personal biography(ies) and all materials

created by or on behalf of the Producer incorporating the same in perpetuity for any lawful

purpose, including, but not limited to advertising, public relations, publicity, packaging, and

promotion of Podcaster and its businesses, products, and services, without further consent

from or royalty, payment, or other compensation.

OWNERSHIP: It is understood that Guest retains ownership of any copyrighted material

provided during the Podcast, however the Producer is hereby granted a non-exclusive,

perpetual, worldwide and royalty-free license to publish such copyrighted work in any and all

media, whether now known or hereafter devised.

Guest further acknowledges that the Producer is the sole owner of all rights in and to the

Interview, the recording(s) thereof, the Program, as “works made for hire” pursuant to 17 USC

§101, et.seq., for all purposes; and that Producer has the unfettered right, among other things,

to use, exploit and distribute the Program, and Guest’s performance as embodied therein in

any and all media or formats, throughout the world, in perpetuity. To the extent this provision

does not convey full ownership of the Interview Guest hereby irrevocably transfers, assigns,

and otherwise conveys to Producer all of Guest’s right, title, and interest, if any, in and to the

interview, including all copyrights and other intellectual property rights in the interview. Any

materials created in connection with the production and distribution of the Program

(“Materials”) become property of Producer, and Producer shall have the sole and exclusive

right to use, exploit and distribute such Materials, throughout the world, in perpetuity

NO OBLIGATION TO USE: Nothing contained herein shall be construed to obligate the

Producer to use or exploit any of the rights granted or acquired by Producer, or to make, sell,

license, distribute or otherwise exploit the Program or Materials whatsoever.

NO ADDITIONAL CONSIDERATION: Guest understands and agrees that the

opportunity of the Interview constitutes sufficient consideration hereunder, and that Guest

shall receive no monetary compensation for appearances on and participation in the Program.

RELEASE; WAIVER: Guest hereby releases and discharges Producer from any and all

liability arising out of or in connection with the making, producing, reproducing, processing,

exhibiting, distributing, publishing, transmitting by any means or otherwise using the

Program, and, to the fullest extent permitted by law, waives all legal and equitable claims

(whether now known or later discovered) relating to the Program whatsoever.

AGREEMENT AND ACCEPTANCE IS ASSUMED BY MOVING FORWARD WITH OUR INTERVIEW.
